Willsons are pleased to bring to the market 9.83 acres of arable and pasture land in 3 separate enclosures on behalf of Mr & Mrs Crust.

All of the land has been well farmed over the years and we believe the fields lend themselves to becoming amenity paddocks.

The land is for sale by Informal Tender in 3 Lots:

Lot 1: 2.69 Acres

Lot 2: 4.04 Acres

Lot 3: 3.10 Acres

Lot 1 is accessed via Toynton Lane, along a right of way over Ings Drove, an unadopted track (as shown dashed blue on the attached plan). The current owners have had a private agreement with an adjoining landowner to access Lot 1 over a portion of adjoining land; this access cannot be guaranteed.

Lots 2 & 3 have direct road frontage access onto Halton Fenside Road, a publicly maintained highway, with Lot 2 also having road frontage access onto Atkinsons Lane.

Each Lot is clearly marked with a “For Sale“ board to aid with identification.


The Freehold interest in the land is being offered for sale with full Vacant Possession upon completion.

The current owners have a License with the National Rivers Authority to graze/mow the area of land which adjoins East Fen Catchwater Drain for an annual payment of £10.
A copy of this agreement can be provided to prospective purchasers if requested.


We are not aware that any of the land has the benefit of any mains services.


Lots 1, 2 & 3 are predominantly Grade 3, with a proportion of Lots 2 and 3 being Grade 2, as scheduled by the Agricultural Land Classification of England & Wales.

The predominant soil type as defined by Soil Survey of England and Wales is Downholland 1 – Deep stoneless humose clayey soils, calcareous in places. Some peat soils and deep humose calcareous silty soils. Flat land. Groundwater usually controlled by ditches and pumps. Risk of wind erosion. The land is level lying.


All of the land is clearly demarcated by boundary hedges and fencing, with the exception of the southern boundary for Lot 1, which adjoins East Fen Catchwater Drain.

The buyer(s) shall deem to have full knowledge of all boundaries and neither the seller nor the selling agents will be responsible for defining the boundaries nor their ownership.


It is understood that the drainage rates are payable to Witham Fourth District Internal Drainage Board.


All of the land has been underdrained in the past, but no plans exist for Lots 1 & 3. Lot 2 was comprehensively underdrained in 1984 and plans are available upon request.


All of the land is registered with the Rural Payments Agency and the Basic Payment Scheme Entitlements are excluded from the sale. The vendors reserve the rights to retain the 2021 Basic Payment Scheme claim. The vendors will make the relevant units of BPS Entitlements available to prospective purchasers at market value if so required.

None of the land is entered into any Natural England Stewardship Schemes.

All of the land lies within a Nitrate Vulnerable Zone as designated by the Environment Agency.


The vendors will be responsible for cross compliance up to the date of completion.
The purchasers will take over the cross compliance obligations upon completion and will therefore indemnify the vendors for any breach of cross compliance which results in a penalty or reduction of the vendors payments from the Basic Payment Scheme, until the end of the current calendar year.
