Willsons are pleased to be able to offer 29.55 Acres of Arable and Pasture Land for sale on behalf of W Taylor & Co.

The majority of the land has been farmed as permanent pasture for a number of years, however, it now has
the benefit of support from Natural England to enter the land into an arable rotation.

The land is to be sold by Informal Tender in 5 Lots:-

Lot 1 – 14.16 Acres at Stickney

Lot 2 – 4.52 Acres at Great Steeping

Lot 3 – 4.89 Acres at Great Steeping

Lot 4 – 4.10 Acres at Great Steeping

Lot 5 – 1.88 Acres at Great Steeping

Lot 1 - Stickney -

The land is situated directly off of the A16, being the main road between Spilsby and Boston, with the land being located in the Parish of Stickney. The land has 2 vehicular accesses off the publicly maintained highway, being directly adjacent to the speed camera to the north of the village of Stickney.

Lots 2, 3, 4 & 5 - Great Steeping -

All of the land is situated off School Lane in the Parish of Great Steeping and has direct road frontage access onto School Lane, being a publicly maintained highway.

Each Lot is clearly marked with a ‘For Sale’ board to aid with identification.

Natural England Consent -

Permission has been granted by Natural England (in a letter dated 20th April, 2021) for the pasture land to be converted back into an arable rotation: “We have carefully considered your proposal to convert all the land enclosures from permanent pasture and enter it back into an arable crop rotation and have concluded that the project does not fall within EIA Agricultural regulations. You may therefore carry out the project without further recourse to Natural England, provided it is undertaken in accordance with the proposals as set out in your application and any other permissions you may need are in place”. Tenure & Possession: -

The Freehold interest in the land is being offered for sale with vacant possession. Lot 1 is currently let on a Summer Grazing and Meadowing License, which is due to terminate on 31st October, 2021, when vacant possession will be obtained.

Holdover -

Lot 2 is currently growing a crop of winter oil seed rape and the vendor reserves the right to holdover for the purposes of harvesting the growing crop and removing the straw until 30th September, 2021.

Early Entry -

Early entry onto the property will be available following the exchange of contracts and the payment of a double deposit (20%) and entry will be entirely at the purchaser’s own risk.

Services -

Lots 1, 3 & 4 have the benefit of mains water supplies being connected to cattle drinking troughs. The supply to Lot 4 is serviced by the same connection and meter as Lot 3 and therefore if Lots 3 & 4 are purchased separately, the water supply to Lot 4 cannot be guaranteed. We are not aware that any of the land has any other mains services connected.

GRADE, SOIL TYPE & TOPOGRAPHY -

All of the land at Great Steeping and Stickney is scheduled as Grade 3 by the Agricultural Land Classification of England and Wales. The predominant soil type as defined by Soil Survey of England and Wales as Wallasea 2 – Marine alluvium and described as “deep stoneless clay soils, calcareous in places, some deep calcareous silty soils“. The land is level lying.

Boundaries -

All of the land is clearly demarcated by hedges and fencing with the exception of the boundary between Lots 4 & 5 which is currently unfenced, with the land being grazed as one parcel. Should the parcels be purchased separately, the purchaser of Lot 5 shall be responsible for erecting a post and rail fence along the boundary within 1 month of completion. The boundary is demarcated on the ground by a red top post at either edge.

The buyer(s) shall deem to have full knowledge of all boundaries and neither the seller nor the selling agents will be responsible for defining boundaries nor their ownership.

Drainage rates -

It is understood that the drainage rates for Lot 1 are payable to Witham Fourth District Internal Drainage Board. The drainage rates for the remaining Lots are payable to the Environment Agency and Lindsey Marsh Drainage Board.

Underdrainage -

Lots 2 & 3 were comprehensively underdrained in the 1980’s and copies of the drainage plans can be made available to prospective purchasers.

BASIC PAYMENT SCHEME, STEWARDSHIP SCHEMES & NVZ -

All of the land is registered with the Rural Payments Agency and the Basic Payment Scheme Entitlements are excluded from the sale. The vendor will make the relevant units of BPS Entitlements available to purchase at market value.

None of the land is entered into any Stewardship Schemes, but it all lies within a Nitrogen Vulnerable Zone.

Cross Compliance -

The vendor will be responsible for cross compliance up to the date of completion. The purchaser will take over the cross compliance obligations upon completion and will therefore indemnify the vendor for any breach of compliance which results in a penalty or reduction of the vendors payments from the Basic Payment Scheme until the end of the current calendar year.

SPORTING, TIMBER & MINERAL RIGHTS -

Sporting, Timber and Mineral Rights are included in the sale insofar as they are owned, subject to statutory exclusions.

WAYLEAVES, EASEMENTS & RIGHTS OF WAY -

We are aware that Lot 1 is subject to a wayleave agreement with Western Power Distribution for electricity cables and poles which cross the land. We are also aware that within Lot 1 there is a mains sewerage pipe which crosses the easterly edge of the land as approximately shown dashed blue on the attached plan.

All of the land is sold subject to and with the help and benefit of all existing rights, including rights of way whether public or private, light, support, drainage, water and electricity supplies and other rights, easements, quasi-easements and all wayleaves whether referred to or not in these particulars.

VAT -

It is not thought that the sale shall attract VAT, however, in the event that any of the property is sold subject to VAT this will be payable in addition to the purchase price.

These have been prepared as accurately as possible and are based on Ordnance Survey Plans and the Rural Land Register maps and although believed to be correct are for guidance and identification purposes only.
