DESCRIPTION
Lot 1 comprises 2 well sheltered adjoining fields with access off Orby Road, Burgh le Marsh. There is a mains water supply to a water trough and this lot has barbed wire stockproof fencing. A public footpath crosses this lot in an east-west direction over OS No. 5646. There is a small pond on the northern boundary of OS No. 4731.

LOT 2 -

Lot 2 was severed by the Burgh bypass and is situated at the end of Common Lane which is a no through road. Access to Common Lane is via Ingoldmells Road. LOT 7 -

Lot 5, 6 & 7 share one mains metered water supply.

OVERAGE: -

In relation to Lots 1-4, the vendors reserve the right to include an overage provision whereby for a period of 20 years, 30% of any uplift in value attributable to the grant of planning permission for use and development other than agricultural and equestrian will be payable to the vendors, such payment to be triggered by the earlier of the implementation of the relevant planning permission or sale of the relevant land with the benefit of the relevant planning permission. Potential purchasers are invited to submit tenders based on no overage, inclusion of an overage provision or both options.

GENERAL REMARKS -

TENURE & POSSESSION -

The land is Freehold and is being sold with Vacant Possession.
Lot numbers 1, 3, 4, 5, 6 & 7 are currently let on grazing licenses until 31st October 2023 and vacant possession will be on or after 1st November 2023. Lot 2 is not let, and vacant possession is available upon completion.

HOLDOVER -

The vendors do not require the Right to Holdover on any lot.

EARLY ENTRY -

There will be no early entry available.

TENANT RIGHT & DILAPIDATIONS -

There will be no claim for tenant right nor any counter claim for dilapidations (if any).

BASIC PAYMENT SCHEME -

The land is registered with the Rural Payments Agency.

CROSS COMPLIANCE -

The vendors will be responsible for cross compliance up to the date of completion. If required, it will be the responsibility of the purchaser to take over cross compliance obligations for BPS up until the end of the scheme year 31st December 2023. The purchaser will indemnify the vendors against any non-compliance which results in a penalty to the vendors’ payment until the end of the current calendar year.

STEWARDSHIP SCHEMES -

None of the land is entered into a Natural England Stewardship Scheme.

NITRATE VULNERABLE ZONE -

All the land is situated within a Nitrate Vulnerable Zone as designated by The Environment Agency.

DRAINAGE RATES -

Drainage rates are payable annually on all lots to Lindsey Marsh Drainage Board.

WAYLEAVES, EASEMENTS, RIGHTS OF WAY -

Lot 1 – A public footpath crosses this lot.
Lot 4 – Electricity poles and overhead wires cross this lot.
Lot 5 – A public footpath crosses this lot.
With the exception of detail contained within these Particulars of Sale, we are not aware that any of the land is subject to or has the benefit of any other wayleaves, easements or rights of way. However, it is sold subject to and with the benefit of all existing rights, including rights of way whether public or private, light, support, drainage, water and electricity supplies and other rights, easements, quasi-easements and all wayleaves whether referred to or not in these Particulars.

SPORTING, TIMBER & MINERAL RIGHTS -

Sporting, timber and mineral rights are included in the sale insofar as they are owned, subject to statutory exclusions.

BOUNDARIES -

All the boundaries are well defined with the majority being watercourses or hedges.
The purchaser shall be deemed to have full knowledge of all boundaries and neither the vendors nor the Agents will be responsible for defining the boundaries or their ownership. The vendors have no information other than that recorded in the Land Registry title documents, copies of which can be obtained from the Agent upon request.

VAT -

The vendors have not opted to tax (therefore the sale of the land shall not attract VAT).

PLANS, AREAS & SCHEDULES -

Plans, areas and schedules have been prepared as accurately as possible and are based on Ordnance Survey Plans and the Rural Land Register areas and although believed to be correct are for guidance and identification purposes only and their accuracy cannot be guaranteed. Interested parties must satisfy themselves as to the extent of the land via their own survey and inspection.

HEALTH & SAFETY -

Lots 1, 3, 4, 5, 6 & 7 are grazed with cattle until the end of the grazing season. Willsons Alford office must be contacted prior to viewing. No dogs or children should be taken when viewing and you enter the land entirely at your own risk. These particulars of sale constitute a permit to view the land at reasonable time of day.

SERVICES -

There is a mains water supply to all lots. Lots 5, 6 & 7 share one water meter. To assist, please include on your Tender form the importance of the supply. If Lots 5, 6 and 7 are sold separately it will be the responsibility of the purchasers to make suitable arrangements regarding the water supply.

GRADE & TOPOGRAPHY -

The land has been graded by the Agricultural Land Classification of England & Wales as Grade 3. All of the land is level lying.

ANTI MONEY LAUNDERING -

In accordance with the most recent Anti Money Laundering legislation the purchaser will be required to provide proof of identity and proof of funds to the selling agent once an offer has been submitted and accepted (subject to contract) and provide all information necessary to comply with Anti Money Laundering Regulations prior to solicitors being instructed.
